TERMS AND CONDITIONS

 

ACCEPTANCE

 

All articles ordered on the Airsoft-one website are contingent upon the following terms and conditions.

 

The buyer can not complete an order on the Airsoft-one website without acknowledging, on the order form, that the present terms and conditions have been read and understood. This active acknowledgement that the general terms and conditions have been read and understood is the equivalent of an electronic signature which for the purposes of the contract between buyer and seller has the same value has a handwritten signature. The order shall be confirmed via email, to the email address specified by the buyer on the order form.

Some orders (large quantities, high monetary value) may be subject to further checks. Airsoft-one reserves the right to request further supporting documentation before dispatching the ordered goods. The information given by the buyer at the time of placing the order on Airsoft-one is binding. In the event of a mistake in the spelling/wording of the delivery details and as such the impossibility of delivering the goods Airsoft-one shall not be liable.

 

PRICE AND AVAILABILITY

 

Prices are marked in Euros (€) inclusive of all taxes (V.A.T. 21%) and are only valid on the date the buyer submits the order form. Marked prices are exclusive of delivery charges however delivery costs shall be indicated before the order is completed. For dispatch outside Belgium, settlement of customs duties, local taxes, import duty or any national tax likely to be chargeable (declarations and/or payments to the authorities and competent bodies of the country of the buyer) remain the sole responsibility of the buyer who is importing the ordered goods. The ordered items remain the property of Airsoft-one until complete payment has been received. Should an item be unavailable at the time of order due to a supply problem, the customer shall be informed as quickly as possible and the option given to either cancel the order and all monies relating to the unavailable item fully reimbursed or an equivalent item sent as a replacement. Orders shall be dispatched within a maximum of 20 working days as of payment. Airsoft-one reserves the right to change the range of products on offer, prices, time for delivery in line with limitations imposed by manufacturers/suppliers. Airsoft-one shall be obliged to inform the customer of any such changes.

 

METHODS OF PAYMENT

 

The following methods of payment are available to the customer at the time of placing the order: bank transfer and PayPal. All orders completed on the site must be honoured within 8 days of completion or the order shall be automatically cancelled.

 

PayPal payments shall be subject to a 4% surcharge.

 

 

 

DELIVERY

 

Items shall be delivered by the carrier to the delivery address indicated by the buyer at the time of placing of the order. Airsoft-one commits to doing everything within its power to deliver the item within the shortest possible timeframe once payment has been received. The estimated time for delivery indicated on the order form is approximate and any potential delays shall not give rise to the right to cancel the order, reject the goods or claim any kind of compensation. Letters of complaint for breach of contract or missing goods must be sent within seven days of the date of reception by the buyer.  In the event of force majeure or a fortuitous event Airsoft-one shall be released of its delivery obligations. Force majeure shall include, total or partial strikes, flooding, fire. Airsoft-one reserves the right to split deliveries, postage and packaging costs being chargeable only once. Should packages that are accepted arrive open or damaged it is essential that the buyer request a statement of damage from the carrier. In the event that these goods are not accepted at delivery, the buyer must ask the carrier to return the package to Airsoft-one accompanied by an official statement attesting to the intentional misrepresentation of goods (Constat de dole et malice). The buyer must retain a copy of this form.

 

WARRANTY

 

Electric powered replicas and gas blow back guns purchased on the Airsoft-one site are covered by a 12 month mechanical warranty subject to products having been used for their intended purpose with due care and attention and having not been tampered or aesthetically altered in any way. Batteries are covered by an 8 day warranty covering any manufacturing fault.  In the event that 6 months of the warranty have already passed and/or a dispute over improper use not covered by the Airsoft-one warranty the manufacturer’s or importer’s warranty (depending upon the article in question) shall come in to play. The manufacturer shall be the sole person responsible for after sales services and for any follow up activity relating to the repair or replacement of faulty goods. AEG replicas under warranty must be presented with the following in order to be covered: proof of purchase, date of purchase, the amount and time period of the warranty, no trace of tampering with guarantee systems (label, rivet, screws, serial number etc.), and the item must be returned in its original packaging with the original accessories (battery charger, batteries, pellet loader etc.) Airsoft-one shall bear the repair costs including tax (labour and parts) for mechanical parts under warranty. Repairs undertaken by Airsoft-one shall only relate to unpredictable mechanical failures and breakdowns thus excluding any kind of maintenance, adjustment or fine tuning activities as well as breakdowns or incidents relating to wear and tear or due to external factors; and for gas blow back guns correct axle and seasonal gas use.

 

Elements not covered or refunded by this warranty:

 

• Damage resulting from a handling error, theft, fire, frost, submersion of replica as well as any damage due to wear and tear of parts or insufficient maintenance.

 

• User negligence and any kind of improper or misuse.

 

• Damage due to lack of or insufficient lubrication.

 

 

DISPUTES

 

When placing an order the buyer is unreservedly bound by the general terms and conditions of Airsoft-one. Any sales dispute shall be subject to Belgian Law before the competent commercial tribunal.
